Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Reflex PMR and its websites, apps, content, and features (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. The Service is intended for medical professionals and trainees for educational purposes.

2. The Service is educational only

Reflex PMR is a board-exam study aid. It is not medical advice, is not a substitute for clinical judgment or primary sources, and does not guarantee any exam result. Learning tools, procedure illustrations, anatomy references, and practice cases are for education and simulated practice only. Do not use them to select treatment, determine a dose, plan or guide a procedure, or make decisions for an individual patient. See our Medical & Educational Disclaimer, which is incorporated into these Terms.

3. Accounts

You are responsible for the accuracy of your registration information and for keeping your credentials secure. Account creation and authentication are handled by our provider (Clerk). You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

4. Purchases and billing

• One-time purchases. Paid access is sold as a one-time purchase of access through a date you choose, billed through our payment processor (Stripe). Nothing auto-renews. When your access ends, it simply ends unless you choose to buy again. We show the price and the date your access ends before you purchase. Reflex does not store your full card number; Stripe handles payment and transaction records.
• iOS app. The iOS app does not sell anything in-app. Purchases are made on our website; access then applies across web and iOS under the same account.
• Refunds. New customers may request a full refund within 14 days of their first purchase by contacting support@reflexpmr.com. After that, fees are non-refundable except where required by applicable law.
• Price changes. We may change prices; changes apply only to future purchases, never to access you have already bought.
• Taxes. Prices exclude applicable taxes, which we may collect where required.

5. License and acceptable use

We grant you a personal, limited, non-exclusive, non-transferable license to access the Service for your own study. You may not:

• share, sell, sublicense, or transfer your account or access;
• copy, scrape, bulk-download, redistribute, or republish the content;
• use the content to build or train a competing product or dataset;
• reverse engineer, circumvent access controls, or disrupt the Service;
• use the Service to make clinical decisions for an individual patient;
• submit identifiable patient information, medical records, patient images, other people’s recordings or personal information, or other confidential information through recordings, text, screenshots, support, or feedback;
• submit, request, reconstruct, or share recalled examination questions or other confidential or protected exam content, or use the Service to violate an exam sponsor’s rules.

Use fictional study scenarios in your practice and submissions.

6. Intellectual property

The Service and its content are owned by Reflex PMR LLC or its licensors and are protected by intellectual-property laws. Third-party images are used under their respective licenses (e.g., Creative Commons) with attribution. These Terms grant no ownership rights.

7. Your feedback

If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

8. AI-assisted features

Explain It sends your spoken-answer recording to Google Gemini for transcription and AI feedback after you agree to that processing. AI output may be inaccurate, incomplete, or out of date and is not authoritative. Do not rely on it for clinical decisions. Practice scores and any simulated grading labels are educational feedback, not official examination results, certification decisions, or determinations of clinical competence or exam readiness. Our Privacy Policy explains the recordings, generated outputs, practice records, and provider processing involved.

9. Disclaimers of warranty

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE CONTENT IS ERROR-FREE OR THAT USE OF THE SERVICE WILL RESULT IN PASSING ANY EXAMINATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REFLEX PMR LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR EXAM OUTCOMES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold Reflex PMR LLC harmless from claims arising out of your misuse of the Service or violation of these Terms.

12. Termination

We may suspend or terminate access for violation of these Terms or to comply with law. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

13. Changes to these Terms

We may update these Terms; material changes will be notified through the Service or by email. Continued use after changes means you accept them.

14. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules.
